rmbrME's service is designed for sharing your contact information and photographs, so you should use the service only if you wish to share this information with others.

Your rmbrME profile can reveal a lot of information about you and the people, places and objects you are connected to. So please think carefully about what information you share in the rmbrME service, including the photographs you choose to upload.

We will analyze information about you and your use of the rmbrME service for marketing and support purposes.

Our employees, contractors and service providers access and use your photographs and information in order to provide the rmbrME service to you.

You can access the information in your account profile and make changes if you wish.

rmbrME respects your privacy and provides this policy statement to inform its customers how their information will be collected, stored and used. WHAT INFORMATION DO WE COLLECT?

When you register with the rmbrME service, we collect various types of information, such as your name, address, email, birthday and mobile phone number, to set up your account. As you use our services you will generate more information, such as comments and notes about your photos, address book entries, and information concerning how you use the service (e.g., what types of photos you send and the people you send them to). When you create an unlock request through rmbrME, your information is sent to the person you specify. They will be able to see your complete profile, as you’ve defined it.

Your photographs provide lots of information. For example, the title of the photograph may identify who you are, where and with whom you were at a particular time, or why you took the photograph. Other people may be in the photograph and how they are portrayed may say something about them and/or your relationship to them. There may be places, scenes or things (buildings, possessions, etc.) in the photographs that provide certain information about you, other people, and/or those places, scenes, or things. Personal circumstances and biographical facts may be obvious from the photos (e.g., your gender, race, or approximate age). Certain photographs may not be shared with our service for the protection of all of our customers (see our Terms of Service for details).

Also as part of the rmbrME service we use your social network information (such as information you have posted on sites like facebook or myspace). To enable this we will have to collect your social network information and load it into the rmbrME service.

We may provide you with synchronization software or online services which you will need to use to allow the rmbrME service to upload your photos and access your social network information. This synchronization software will automate the process of obtaining such information, so we will continue to collect such photographic information and social network information while you use the rmbrME service.

WHAT ARE COOKIES AND WHY DO WE USE THEM?

A cookie is a small text file of data that is sent to your browser from a Web server and stored on your computer's hard drive. Your browser then returns that small text file every time the browser calls that Website. They were originally invented to hold shopping cart data. Technically, we could store anything we want there, but we only use the rmbrME cookie to store a session ID. The reason this is necessary is because the Internet uses HTTP which as a protocol is "stateless". Every time you click on our Website, HTTP will not know who you are and you would have to enter your name and password on every single page but for the use of a Cookie. When a user logs into our rmbrME service or visits our Website, we create a session ID and store this in the cookie. For example, the rmbrME cookie allows us to auto-fill your email address on the Sign-In page, so that you don't have to re-enter it each time you log-in. Every time the logged-in customer clicks on something, the browser (or Flash) sends the cookie with that session ID and we use that as part of our verification processes. There are a few alternative ways to achieve this type of verification, but cookies are the most widely used. The rmbrME cookie is a standard Ruby on Rails cookie. So our cookie is based on a random number and does not have any personally identifying information. rmbrME also uses the rmbrME cookie to store and track information about your use of our service. We may eventually commence usage of third party cookies. An example would be a cookie that AdClick or Google might use to track your movements across Websites on which they have placed an advertisement. We will update this Privacy Policy before commencing use of such third party cookies, but please be aware that they may be a feature of the rmbrME service in the future. You can configure your browser not to accept cookies, but this will interfere with your ability to use our services and certain parts of our Website.

HOW WE USE THE INFORMATION WE COLLECT

We track, store and analyze the personal information that we collect when you use the rmbrME service so that we can provide services and support to you. These services include the current rmbrME photosharing service, but in the future may include other services. You can terminate or opt-out of any or all of these services at any time. We will share your personal information with other people, but only in the ways that we have told you about and that you have agreed to either in this policy or elsewhere in our service. For example, we will share your photographic information with the people that you have included in your address book unless you opt to block certain people. If you elect to use our service to share your photos with certain websites (such as myspace) you will be sharing those photos with anyone who visits that website and can access your information on it. We will not share your photographic information with other people unless they are in your address book or you have elected to give such people access to your photographs on a website like myspace and have sent your photographs to that website using our service. To provide you with more relevant and targeted advertising (including information about carefully selected products and services of other businesses), we will also share, on an anonymous and non-personalized basis, analysis and data concerning our customers and their use of our rmbrME service, but we will not give or sell your specific, personally identifying information (name, address, email, etc.) to anyone else for marketing or advertising purposes. We will notify you via email or through the mail about new features, services and promotions and we will provide you with service announcements (e.g. if the service will be unavailable for a period of time). You can opt-out of the marketing and advertising by clicking here, but you cannot opt-out of the service announcements as these contain important information regarding your use of the rmbrME service.

We will also share personal information with our employees and external businesses that provide services that we use to support the rmbrME service. For example, we use external providers to store the photographs and other information from our service. We will also need to share certain information with credit card and payment processing companies in order to process the payments you make for those of our services that involve a fee. In order to transfer photographs to your friends and family we will need to give copies of the photographs to telecommunications companies and others involved in the transmission of those photographs (e.g. your mobile carrier, Internet Service Provider, and other companies that distribute and process messages).

If you delete any of your photographs or other information, please note that it may take a few weeks or longer before all copies of those deleted items have been removed from our systems and, because of the nature of computer systems, it may not be possible for us to remove every single copy of such photographs and information. Also, we have no control over whether people who receive your photographs via the service have cached or archived screenshots of your photos.

In addition, you should not rely on our service as a backup or archiving method for keeping your photographs. You alone are responsible for ensuring that you have a backup of any photos that you wish to preserve.

CHILDREN

The rmbrME service is not designed for children and we do not intentionally collect personal information from children under the age of 13. Security

rmbrME takes appropriate measures to protect its customers' information. For example we use SSL encryption when we collect credit card or other payment information. However, please note that our service transmits photographs over forms of communication that are inherently insecure, such as instant messages, websites and cellular phones. Although we allow you to control settings for the transfer of your photographs using the service, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of the friends and family with whom you choose to share your photographs, nor can we control the conduct of unauthorized persons who attempt to hack into our systems. Therefore, we cannot and do not guarantee that your photographs and information will not be viewed, used, or distributed by unauthorized persons. You are responsible for protecting your account password and user ID. You are also responsible for your choices with respect to your use of the rmbrME service. Access and changes to your information

You can access and control the information in your account at any time. You can modify or delete your profile or account by going to your account profile page. However, if you have already sent information to one or more persons (for example, in a message), then our service cannot be used to remove or delete such information from such persons' possession. If you wish to have access to other information about you that we may hold, please contact us at privacy at rmbrME dot com.

MERGERS, TAKEOVERS AND SALES

It is possible that our business and/or related assets might be acquired or transferred as part of a merger, takeover or sale. If this happens, you understand and agree that rmbrME and its successors may assign its rights to personal information collected by rmbrME for purposes of such mergers, takeovers or sales.

LEGAL REQUESTS

We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Additionally, we may share account or other information when we believe that doing so is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

CHANGES TO THIS POLICY

Our business is expanding and changing, so our Privacy Policy is likely to evolve as well. We will post changes to our Privacy Policy from time to time and those changes will apply to your continued use. If changes to our Privacy Policy represent material changes to how we use your personal information, those changes will apply only to information that we collect after we make the change to the Privacy Policy, but in all other respects the current Privacy Policy will apply to all personal information that we hold about you.
